Who is responsible for your information

Fineapple Promotions (Pty) Ltd, trading as Fineapples (“we”, “us”), operates fineapples.co.za and provides promotional staffing and modelling services. This notice explains how personal information relating to website visitors, prospective clients and talent applicants is handled under the Protection of Personal Information Act 4 of 2013 (POPIA). Requests for access to records may also be subject to the Promotion of Access to Information Act 2 of 2000 (PAIA).

Information requested and where it comes from

We request information directly from you. Client enquiries ask for your name, email address, telephone number, event type, location, date, start time, duration and dress requirements. Talent applications ask for your name, birthdate, location, contact details, vehicle availability, promotional-modelling experience, height, clothing and shoe sizes, Instagram link, ID image and photographs. You may also provide information in correspondence. Our website includes an email subscription field.

Technical information, such as an IP address, browser details and requested pages, may be generated when you visit the website or your browser connects to external resources. Please do not provide unrelated sensitive information or another person’s documents without authority.

Purposes, choices and lawful grounds

Client information is used to understand enquiries, communicate with you and arrange suitable staffing or services. Application information is intended to identify and assess applicants, consider suitability for opportunities and communicate about an application. Measurements and photographs relate to the assessment of talent and role requirements. An ID copy is requested for application identification and assessment; it is not a requirement imposed by POPIA.

Submitting an enquiry or application is voluntary. Information marked as required by a form is required for that submission, not necessarily by law. If information reasonably necessary to respond or assess suitability is not provided, we may be unable to progress your request. Contact us if you cannot provide a requested document or wish to discuss a less intrusive alternative.

Processing must be supported by an applicable POPIA ground. Depending on the purpose, this may be consent; steps necessary to conclude or perform a contract with you; compliance with a legal obligation; or a legitimate interest recognised by POPIA, assessed against your rights. A website visit or enquiry is not blanket consent to unrelated uses. Any additional purpose requires appropriate notice and a lawful basis.

Identity documents, photographs and adults only

Identity documents and photographs must be limited to what is relevant and reasonably necessary for the stated purpose. They must not be used for unrelated purposes merely because they were supplied. Publishing an applicant’s profile or photographs, or using images in advertising, requires a separately established lawful basis and appropriate notice. This policy does not grant permission to publish your photographs or an image licence. Special personal information requires the additional authorisation applicable under POPIA.

We do not accept applications from anyone under 18. If you are under 18, do not submit an application, ID document or photographs. Please contact info@fineapples.co.za if information about a child has been submitted by mistake. Such information must be removed unless a lawful retention requirement applies.

Recipients and service providers

Access and disclosure must be limited to people who need information for a lawful purpose. Relevant service-provider categories may include website hosting, technical support, email and cloud-service providers. Providers processing information on our instructions must be subject to appropriate confidentiality and security obligations.

Where considering or arranging a particular talent engagement requires sharing information with a prospective client, only relevant information may be shared on an applicable lawful basis and with appropriate notice. Submitting an application does not authorise unrestricted sharing of ID documents or photographs. Information may also be disclosed where required by law or justified to establish, exercise or protect legal rights.

Processing outside South Africa

Hosting, email or external online services may involve processing outside South Africa. Any transfer of personal information outside South Africa must satisfy section 72 of POPIA, including adequate protection under an applicable law or binding agreement, or another applicable statutory ground. Contact us for information about a transfer relevant to your personal information.

Cookies and external resources

The website uses WordPress and includes Google Fonts resources and Instagram-related functionality. When external content loads, the external service may receive technical information, such as your IP address and browser details. Following a Facebook, Instagram or other external link takes you to a service governed by its own privacy terms.

Cookies or similar technologies may support website functions such as sessions, preferences and embedded services. Manage cookies through your browser settings; blocking necessary cookies may affect functionality. Browser controls do not replace any consent or other lawful basis required for a particular tracking activity. This notice does not grant blanket consent to advertising or analytics tracking.

Retention and deletion

Unsuccessful applications, including ID copies and photographs, are deleted immediately after rejection, unless a specific lawful retention requirement applies. Any exception must be limited to the information and period justified by that requirement.

Other information, including successful applications and client correspondence, must be kept only for as long as necessary for the stated purpose or otherwise authorised by law. Relevant criteria include an ongoing engagement or service relationship, outstanding enquiries, applicable recordkeeping obligations and the establishment or defence of legal claims. When retention is no longer authorised, information must be deleted, destroyed or de-identified appropriately. You may ask us about the retention basis applicable to your information.

Security

POPIA requires reasonable technical and organisational measures against loss, unauthorised access and unlawful processing, and appropriate arrangements with service providers acting as operators. Where a security compromise triggers notification duties, notification to the Information Regulator and affected people must follow POPIA. No website transmission or storage system can be guaranteed completely secure.

Marketing and subscriptions

An enquiry or application does not automatically subscribe you to marketing. Electronic direct marketing must comply with section 69 of POPIA, including its consent or qualifying existing-customer conditions and opt-out requirements. You may object to direct marketing or withdraw applicable consent by emailing info@fineapples.co.za. Withdrawing consent does not retrospectively invalidate lawful processing before withdrawal.

Your rights and complaints

Subject to applicable legal conditions, you may ask whether we hold your personal information, request access, seek correction or deletion, object to processing, or withdraw consent where consent is the basis. Send requests to info@fineapples.co.za. Proportionate proof of identity may be needed to protect your information. Any applicable access procedure, lawful fee or reason information must be retained should be explained when your request is handled.

You may complain directly to the Information Regulator (South Africa), without first completing our internal process. Changes to this policy
